UNWG on BHR Regional CEE&CA Consultations on the rights of LGBTI people in the business context (15.03, 14:00 CET)

On behalf of the UN Working Group on Business and Human Rights, we have the pleasure to invite you to

a closed consultation on respecting the rights of LGBTI people in the context of business activities:

organized in collaboration with  the Polish Institute for Human Rights and Business and Yaroslav Mudryi National Law University

on 15 March 2024, at 14.00 – 15.30 CET (Zoom).

The meeting will provide an opportunity for the Working Group to seek the inputs on its forthcoming report to the 79th session of the Assembly General in October 2024 on respecting the rights of LGBTI people in the context of business activities: fulfilling obligations and responsibilities under the UNGPs.

With reference to the attached concept note for the consultation which includes questions to guide the discussion, the Working Group would welcome receiving participants’ views on elements and focus areas that it should consider for inclusion in this report, with specific emphasis of practical examples of positive practices.

The consultation will be opened and moderated by the current Vice-Chairperson of the UN Working Group on Business and Human Rights, Fernanda Hopenhaym, Member leading on the consultation and drafting process for this report.The consultation will be held in English. We currently undertake effort to secure funds to cover the translation into other languages.

Direct link: https://ucci.org.ua/en/press-center/ucci-news/protsedura-zasvidchennia-fors-mazhornikh-obstavin-z-28-02-2022The Ukrainian Chamber of Commerce and Industry (hereinafter – CCI of Ukraine) on the basis of Art. 14, 14’ of the Law of Ukraine „On Chambers of Commerce and Industry of Ukraine” of 02.12.1997 № 671/97-VR, the Statute of the CCI of Ukraine, evidenced force majeure circumstances (force majeure): military aggression of the Russian Federation against Ukraine, which led to the imposition of martial law from 05:30 on February 24, 2022 for 30 days, according to the Decree of the President of Ukraine of February 24, 2022 № 64/2022 „On the imposition of martial law in Ukraine”.Considering the above-mentioned, the CCI of Ukraine confirms that these circumstances from February 24, 2022 until their official ending, are extraordinary, unavoidable and objective circumstances for business entities and / or individuals under the contract, separate tax and / or other obligations the fulfillment of which occurred in accordance with the terms of the contract, agreement, legislative or other regulations and the fulfillment of which became impossible in the set deadline due to the occurrence of such force majeure circumstances (force majeure).

11. Examples of activities by companies:

The business community and individual companies are undertaking numerous actions aimed both at employees in Poland, their families, employees from Ukraine and their families. Forms of support vary and include:- providing some additional days of paid leave for Ukrainians to take care of relocating their families;- paying out  salaries for 2 – 3 months in advance to help carry those extra costs;
– providing one off non-refundable financial assistance to all UA workers who decided to bring their families to Poland.Companies are also organizing webinars focused on mental health, how to deal with the current situation, how to talk to children about the war, how to prepare if one wants to take on a refugee family to live with them, etc. Hotels are offering accommodation free of charge.
Railway (SOE) and many municipal companies provide free of charge transport services to refugees.Many are providing financial and in kind assistance in bringing the families of workers from Ukraine, or relocating the personnel from UA with families to Poland, and offering additional assistance and covering cost of accommodation for some time.
